Malabar Institute of Medical Sciences Ltd. Vs DCIT (Kerala High Court)

The Kerala High Court addressed an income tax appeal concerning the nature of an order passed by the Commissioner of Income Tax under Section 263 of the Income Tax Act. The assessee, Malabar Institute of Medical Sciences Ltd., challenged the Income Tax Appellate Tribunal’s (ITAT) decision, which had dismissed their appeal against a revised assessment order. The ITAT held that the assessee should have separately challenged the Section 263 order, which had remanded the assessment for fresh consideration, before appealing the subsequent assessment. The High Court, however, disagreed, stating that the Section 263 order constituted an open remand, not a closed one, and therefore, a separate challenge was unnecessary.

The court emphasized that the Commissioner’s order under Section 263, which found the original assessment erroneous and prejudicial to revenue interests, directed a fresh assessment on merits. The High Court argued that the ITAT erred in insisting on a separate challenge to the Section 263 order, especially since the Commissioner of Income Tax (Appeals) had already addressed the revised assessment order on its merits. The court concluded that the ITAT should have also considered the appeal on its merits, rather than dismissing it for lack of a separate challenge to the Section 263 order. Consequently, the High Court set aside the ITAT’s order, restored the appeal, and directed the tribunal to reconsider the case on its merits. The court clarified that the assessee was not required to challenge the Section 263 order independently, as it was not a closed remand, and allowed the appeal, answering the questions of law in favor of the assessee.
