Note 1 of Chapter 7 of ITC(HS) Classification of Export & Import Items (Chapter 7 deals with Edible Vegetables and Certain Roots and Tubers) stipulated that reference to onions in this chapter includes onions fresh or chilled, frozen, provisionally preserved or dried. This note has also been extracted in the Notification No. 13 of 22.12.2010. Therefore, the item description in the Notification No. 13 dated 22.12.2010 is clear leaving no room for ambiguity.
In exercise of the powers conferred by Section 5 of Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Para 2.1 of the Foreign Trade Policy, 2009-2014, the Central Government hereby makes, with immediate effect, the following amendment to Notification No. 38 (RE-2007)/2004-2009, dated 15.10.2007 read with Notification No. 93 (RE-2007)/2004-2009 dated 1.4.2008, as amended from time to time.
In exercise of the powers conferred by Section 5 of Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Para 2.1 of the Foreign Trade Policy, 2009-2014, the Central Government hereby makes, with immediate effect, the following amendment to Notification No. 03(RE-2010)/2009-14 dated 30.08.2010 read with Notification No. 55 /2009-2014 dated 06.08.2010 and also read with Notification No.38 (RE-2007)/2004-2009, dated 15.10.2007 and Notification No. 93 (RE-2007)/2004-2009 dated 1.4.2008, as amended from time to time.
In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No. 22 of 1992) read with Para 2.1 of the Foreign Trade Policy, 2009-2014, the Central Government, with immediate effect, makes the following amendments in Notification No. 13(RE-2010)/2009-14 dated 22.12.2010.
Since the last date of export is 31st March, 2011, the allocation would be completed as expeditiously as possible, on receipt of the confirmatory e-mails (last date of receiving such e-mails is 14.2.2011). In view of the above, the allocation of cotton yarn for export as stipulated in Policy Circular No. 15 dated 1.2.2011 is not being made today.
It is observed that the following Pre-Shipment Inspection (PSI) Agencies listed under Appendix – 5 of the Handbook of Procedures had issued wrong Preshipment-Inspection certificates. It has, therefore, been decided not to accept the PSI Certificates issued by these agencies.
In exercise of powers conferred under paragraph 2.4 of the Foreign Trade Policy, 2009-2014, the Director General of Foreign Trade hereby makes the following amendment inAppendix-5 (List of Inspection and Certification Agencies) of Handbook of Procedures Vol.I (Appendices and Aayat Niryat Forms) 2009-2014.
Where any person makes or abets or attempts to make any export or import in contravention of any provisions of this Act or any rules or order made thereunder or the Foreign Trade Policy, he shall be liable to a penalty of not less than ten thousand rupees and not more than five times the value of the goods or services or technology in respect of which any contravention is made or attempted to be made, whichever is more.
DGFT Policy Circular No.77(RE-2008) dated 31.3.2009 and DGFT Policy Circular No.24(RE-2009-14) dated 11.2.2010 stand withdrawn.
Therefore, (i) import of Tapioca Starch and Wheat Gluten as alternative inputs against import item No. 1 of SION E-5 and, (ii) import of Lactose / Fructose / Maltose / Mannitol / Sodium Saccharin / Artificial Sweetening Agents, as alternative inputs against import items No. 2 of SION E-5 and import item No. 1(a) of SION E-1, is not to be allowed, under Advance Authorisations and Duty Free Import Authorisations issued agasint SIONs E-1 & E-5.
