 THE RAJASTHAN TAX CONSULTANTS’ ASSOCIATION

Date: June 20,2020

To,

The Hon’ble Chief Minister,
Government of Rajasthan,
Jaipur

Sub: Request for extension of due dates for submission of C-forms and ITC mismatch under VAT regime and address some other important issues

Respected Sir,

The trade & industry and tax consultants are facing some problems which are enumerated below. We invite your kind attention on the same.

1. Extension of due date of furnishing of declaration form due to COVID-19 effect

Sir the last date of filing of declaration forms is June 30,2020. It is requested to extend the due dates of declaration forms like C-forms from June 30,2020 to September 30,2020. Due to COVID 19 situation, it is very difficult to make the compliance.

2. Amnesty Scheme

Sir the Government of Rajasthan had promised in the state budget to bring the Amnesty Scheme to settle the old dues. The officers of the department are making recovery by attaching the Bank accounts and by taking coersive measures. Sir in that situation there will be no use of amnesty scheme. Please clarify whether amnesty scheme is going to come or not.

3. Coercive action in Demand Recovery

The department is recovering demand without disposing off the rectification application. In some cases, the rectification applications were rejected without giving any notice to the dealer and demands have been created without considering all the papers and submissions filed by the dealer.

4. ITC Mismatch

The assessee has submitted the details of ITC mismatch manually which were in accordance with department guidelines but they are still pending. Department is insisting to submit the documents again. If the dealers have furnished all the required documents online, there should be no calling of physical presence by issuing the notice.

5. Rejection of GST Refund Application

The officers of the department are rejecting the refund application without any cogent reasons. It is resulting into hardship to the trade.

Sir kindly consider the above issues and help trade, industry and consultants by extending the current due dates for the submission of C-Forms and ITC mismatch for the year 2016-17 & 2017-18 for the next 3 months. We shall be highly obelized.

Thanking You

Yours Sincerely

Satish Kumar Gupta
President (RTCA)
