In re Allied Castalloys India Private Limited (GST AAR Rajasthan)
Allied Castalloys India Private Limited, a manufacturer of “Blades” used as spare parts in agricultural Chaff Cutter machines for cutting animal feed, sought an advance ruling on the appropriate HSN classification for these goods. The applicant was currently classifying these blades under HSN heading 8208 40 00 (knives and cutting blades for machines) with an 18% GST rate. They requested a ruling to classify them under HSN heading 8436 10 00 or 8436 80 90 (agricultural machinery for preparing animal feeding stuffs), which attracts a 12% GST rate, citing similar practices in other states.
The applicant argued that Chapter 82 pertains to “tools,” not machine parts, referencing Note 1(f) of Section XV which excludes articles of Section XVI (including Chapter 84). They emphasized that Note 2 of Section XVI specifically addresses the classification of machine parts under Chapters 84 and 85. Applying the “principal use” and “suitability for use” tests, the applicant maintained that the blades, being specifically designed and solely used in Chaff Cutter machines, should be classified alongside the machine under Chapter 84. Furthermore, they invoked Rule 3(a) and 3(c) of the General Rules of Interpretation, asserting that HSN heading 8436 10 00 provides a more specific description considering the end-use, thus taking precedence over the more general heading 8208 40 00. The applicant supported their claim by referencing precedents from CESTAT and the Supreme Court, which underscore the importance of specific descriptions and the “predominant use” principle in tariff classification disputes.
