PUBLIC NOTICE No. 45/ 2004-09

NEW DELHI: the 14th January, 2005

In exercise of powers conferred under paragraph 2.4 of the Foreign Trade Policy, 2004-09, the Director General of Foreign Trade hereby makes the following corrections/amendments in Handbook of Procedures (Vol. I).

1. In paragraph 2.20 related to “Execution of Bank Guarantee/Legal Undertaking for Advance Licence and EPCG Scheme”, wherever the words “with 15% interest” appear, the same should be deleted.

2. After the second sub-paragraph of paragraph 2.50, the following sub-paragraph should be added:

“DGFT in association with the Administrative Ministries/Departments and the Trade Associations will organize Industry Outreach Programme on regular basis for an effective awareness among the exporters/importers dealing with the trade, in particular, in SCOMET items.”

3. Paragraph 4.4.5 should be amended as follows:

“Exports made against the Government of India/EXIM Bank Line of Credit would be entitled for benefits under the Advance Licence Scheme. Further, exports made under Deferred Payment/Suppliers Line of Credit Contract backed by ECGC Cover would also be entitled for the benefit under the Scheme.”

4. The following new paragraph 4.4.6, may be added as follows:

“Items reserved for imports by State Trading Enterprises cannot be imported against advance licence. However those items can be procured from State Trading Enterprises against ARO issued to advance licence holder.”

5. Paragraph 4.10 related to “Amendment of Export item and inputs” stands amended as follows:

“An application for amendment of an export item or inputs under SION or under Adhoc Norms may be filed by any manufacturer or merchant exporter as per Appendix 10J of the Handbook (Vol. I).

The applicant would give the justification for seeking the amendment and the same would be considered by the Regional Office with the specific approval of the head of the Office.

6. The following sentence may be added after the first sentence of paragraph 4.24A(b).

“Items reserved for imports by State Trading Enterprises cannot be imported against advance licence. However those items can be procured from State Trading Enterprises against ARO issued to advance licence holder.”

7. A new sub-paragraph may be added after paragraph 4.25 related to “Fulfillment of Export Obligation”

4.25.1 However a licensee holding an advance licence for Physical export has an option either to export directly or to supply the product to EOU/ EHTP/STP/BTP units. Similarly a licensee holding an advance licence for deemed export (for supply to EOU/ EHTP/STP/ BTP units only) has an option either to supply to EOU/ EHTP/STP/ BTP units or export directly.

8. The following sub-paragraph may be added at the end of paragraph 4.31:

“Items reserved for imports by State Trading Enterprises cannot be imported against advance licence. However those items can be procured from State Trading Enterprises against ARO issued to advance licence holder.”

9. A new paragraph may be added after paragraph 4.31A as follows:

“Exports made against the Government of India/EXIM Bank Line of Credit and exports made under Deferred Payment/Suppliers

Line of Credit Contract backed by ECGC Cover would also be entitled for the benefit under DFRC Scheme.”

10. The following new sub-paragraph may be added at the end of paragraph 5.7.3:

“Exports made against the Government of India/EXIM Bank Line of Credit and exports made under Deferred Payment/Suppliers Line of Credit Contract backed by ECGC Cover would also be counted for fulfillment of export obligation under the Scheme.”

11. Paragraph 5.10 stands amended as follows:

“If the licence issued under the scheme has actually been utilized for import in excess up to 10% of the CIF value/Duty saved amount of the licence, licence shall be deemed to have been enhanced by that proportion. The Customs shall automatically allow the clearance of goods in excess up to 10% of the licence value/Duty saved amount, as the case may be, without endorsement by the licensing authority.

In such cases, the licence holder shall furnish additional fee to cover the excess imports effected in terms of CIF value/Duty saved amount subsequently. The export obligation shall automatically stand enhanced proportionately.”

12. In Appendix 12 related to “Format of Project Authority Certificate”, the “NOTE” appearing in the first page may be amended as follows:

“NOTE: Please see paragraph 4.1.3 of the Policy and paragraph 8.2 and 8.6 of the Handbook of Procedures, Vol. I.”

13. Paragraph 1(c) and Sl. No. 5 appearing in the ‘Note’ below paragraph 3 of Appendix 12 stand deleted.

14. In Appendix 15, the following new Agri-Export Zones should be added after Sl. No. 54:

15. In Appendix 22 related to “Bank Certificate of Export and realization”, Sl. No. 2 appearing under the Heading ‘Note’ in the Bank’s Certificate, may be amended as follows:

“FOB actually realized and date of realization of export proceeds are to be given in all cases except where consignment has been sent against confirmed irrevocable letter of credit or exports made against the Government of India/EXIM Bank Line of Credit or exports made under Deferred Payment/Suppliers Line of Credit Contract backed by ECGC Cover. An endorsement to that effect need to be endorsed in BRC.”

16. Sl. No. 5 of Appendix 28 related to “List of Inspection and Certification Agencies” stands amended as follows:
