Supreme Court Directions for Effective Implementation of the Sexual Harassment of Women at Workplace Act, 2013
In a judgment issued on May 12, the Supreme Court of India highlighted the “serious lapses” and “uncertainty” in the implementation of the Protection of Women from Sexual Harassment (PoSH) Act, which has forced many working women to leave their jobs. The case of Aureliano Fernandes v. State of Goa and Others involved a challenge to the inquiry conducted by the Internal Complaints Committee (ICC) established by Goa University. The appellant argued that the inquiry did not adhere to due process.
In this case, multiple complaints of sexual harassment were filed by the student body against Mr. Aureliano Fernandes (the appellant), leading to an inquiry. As a result of the inquiry, the appellant was dismissed from the university and barred from government employment in Goa.
