Subject: Extension of last date for annual filing of companies under the Companies Act, 2013 

This has reference to ICSI letter dated 15th October, 2018 (copy enclosed) on the above-mentioned subject wherein we had requested to consider granting extension of time for filing the financial statements for the financial year ended 31st March, 2018.

In addition to the difficulties referred to in the previous letter, we wish to bring to your kind notice another major practical difficulty being faced by the corporates. In case of directors who have not filed e-form DIR-3 KYC within the stipulated time, their DIN has been deactivated. As a consequence, the companies having such directors are not able to file their financial statements.

Considering the above facts in consonance with those submitted vide ICSI letter dated 15th October, 2018, you are once again requested to kindly consider granting an extension of time for filing the financial statements for the financial year ended 31st March, 2018 up to 31st December, 2018 without levying an additional fee.

 Subject: Extension of last date for annual filing under the Companies Act, 2013

Sir,

This is with reference to the provisions of Companies Act, 2013 which require filing of financial statements and Annual Return by every company with the Registrar within thirty days and sixty days respectively from the date of Annual General Meeting.

In this regard, we wish to bring to your kind notice that many requests from companies/ professionals are being received for extension of last date for filing of annual forms due to the following reasons:

  • Additional time being taken in XBRL conversion process and on account of implementation of IndAS.
  • Issues faced because of ‘technical errors during pre-scrutiny in XBRL Validation Tools.
  • Applicability of additional fees of Rs. 100 per day on delayed filing of annual documents has been introduced for the first time and extension of last date without the said fees will provide much needed relief.

Further, it may be noted that the CBDT has also extended the due date for filing Income Tax Returns along with Audit reports for the corporates up to 31st October, 2018.

Considering the above facts, you are requested to kindly consider granting extension of time for filing the financial statements for the financial year ended 31st March, 2018 up to 31st December, 2018 without levying additional fee.
