The Ministry of Corporate Affairs (MCA) has imposed a penalty on Moneshi Agro Industries Limited for failing to file its Annual Return for the financial year 2018-19, as required under Section 92 of the Companies Act, 2013. Despite the due date of November 29, 2019, the company did not submit the return until the date of the Show Cause Notice issued in October 2020, resulting in a delay of 324 days. This violation led to the imposition of penalties under Section 454 of the Act. The penalty for non-compliance includes a fine of Rs. 50,000 for the company, with an additional Rs. 100 per day of continued default, summing up to Rs. 82,400 for the company and its officer, Mr. Sunil Tukaram Pawaskar, who is the whole-time director.

The penalty is based on the default period, and the total amount of Rs. 1,64,800 includes penalties for both the company and its officer, each liable for Rs. 82,400. The company and its officers have 90 days to pay the penalty through the MCA portal. Failure to comply with the payment will lead to further legal action, including potential fines or imprisonment for officers in default. The company is required to file INC-28 along with payment proof and a copy of the adjudication order. An appeal against this order can be made to the Regional Director within 60 days.
