Sushanto Roy, CEO, Sahara Prime City, has in a pre-Budget wish list of expectations said: “Given the pent-up demand for affordable housing which was discovered during the recent slowdown there is a need to reintroduce tax holiday under section 80IB for housing projects constructed after March 31, 2008.” Tax holiday for hotels, under section 80ID should be extended to 10 years from existing time limit of 5 years, in view of the long gestation period for the industry, he said.

In a pre-Budget wishlist, Vinod Juneja, managing director, Braj Binani Group, said, “I expect the finance minister to target the GDP growth of at least 8% or higher for the next 3 financial years.” “On tax reforms front, I would be very happy to see the reduction in individual income tax levels as it leaves the consumer with more spending power hence builds consumption leading to higher economy growth. Also I expect reduction in the corporate tax rates.”

Provision for Gratuity & Leave Encashment not Allowable

Before 2008-09, deduction towards leave encashment and gratuity was a controversial issue following a Calcutta High Court judgment in the case of Exide Industries. The court ruled in favour of Exide and against the revenue department, saying that such provisions whether paid or not were eligible for deductions on the basis of actuarial valuation. A stay was announced in 2008 for 2008-09 returns assessed in the current financial year.

Income tax return of brokers who claimed rebate u/e 88E will be scrutinised

The Income Tax Department has decided to scrutinise all returns filed by brokers and market players who seek rebate after paying the securities transaction tax (STT).The department, in its tax returns for 2008-09 that is assessed in the current financial year, found that most of brokers or market entities paying STT calculated total income and the tax liability on such income before availing of the rebate under section 88E of the Income Tax Act.

Over the past two months, at least a dozen senior officers of the Income-Tax department, belonging to the elite Indian Revenue Service (IRS), have opted for voluntary retirement, a government scheme that allows them to quit before the statutory retirement age. These officers are likely to end up in the private sector, most likely as consultants, to get around rules that prevent government employees from working within a year of quitting.

The Direct Taxes Code 2009 is now on the back burner. The Union finance ministry has veered round to the view that its bold move to reform direct taxes should be subjected to further scrutiny. Contrary to earlier expectations, therefore, the Direct Taxes Code 2009 will not be presented to Parliament as a Bill along with the Union Budget for 20010-11 on February 26.

The assessee, a co-op credit society, was engaged in providing credit facilities to its members and also marketing the agricultural produce of its members. The assessee had surplus funds which it invested in short-term deposits with banks and govt securities. The question arose whether the said interest earned on the said deposits was “business profits”
