153C Order Cannot Stand Without Proper Satisfaction: ITAT Amritsar Remands Legal Issue

The Amritsar Bench of the ITAT allowed the assessee’s appeal for AY 2011-12 for statistical purposes, holding that the CIT(A) failed to adjudicate a vital legal ground challenging the validity of proceedings under section 153C for want of proper satisfaction recording.

In this case, search under section 132 was conducted on sister concerns, and proceedings against the assessee were initiated under section 153C. The assessee specifically contended that the mandatory satisfaction note was not recorded in the case of the searched person, but only in the assessee’s own file—contrary to the requirement laid down by the Supreme Court in Manish Maheshwari (289 ITR 341). Despite detailed written submissions and supporting case law, the CIT(A) dismissed the ground perfunctorily, stating that no specific arguments were made.

The Tribunal observed that the legal issue went to the root of jurisdiction and ought to have been decided first. Since the CIT(A) neither examined the satisfaction note nor adjudicated the jurisdictional objection, the appellate order was held to be vitiated. While noting the Revenue’s reliance on Super Malls Pvt. Ltd. (SC), the ITAT refrained from expressing any opinion on merits.

Accordingly, the ITAT set aside the CIT(A)’s order and remanded the matter to the CIT(A) to adjudicate the jurisdictional validity of section 153C proceedings after considering the assessee’s submissions and precedents. All issues were left open, and the appeal was allowed for statistical purposes.
