Central Board of Direct Taxes, in exercise of powers conferred under section 119 of the Income Tax Act, 1961, hereby extends the ‘due date’ of filing of returns of income for the Assessment Year 2012-13 to 31st August 2012 in respect of assesses who are liable to file such returns by 31st July 2012 as per provisions of section 139 of Income Tax Act, 1961.
Bottom line –
The Order issued by CBDT used the word such returns which gives the impression that due date is extended only for those Individual and HUF for whom e-filing of Income Tax Return has been made mandatory. Lets wait for official clarification from CBDT on this.
Clarification- As per clarification provided by one of the CBDT members on phone it is confirmed that due date is extended to all assessee who are liable to file return by 31st July 2012. CBDT has finally clarified by its press release dated 1-8-2012 that it Extended Due Date to 31.08.2012 for all returns which were due to be filed by 31st July, 2012

Order under Section 119 of the Income Tax Act. 1961 On consideration of the reports of disturbance of general life caused due to failure of power and further in consideration of the fact that the e-filing of returns for a specified category of individuals and HUF has been made mandatory, the Central Board of Direct Taxes, in exercise of powers conferred under section 119 of the Income Tax Act, 1961, hereby extends the ‘due date’ of filing of returns of income for the Assessment Year 2012-13 to 31st August 2012 in respect of assessees who are liable to file such returns by 31st July 2012 as per provisions of section 139 of Income Tax Act, 1961.
It is welcome but the diffficulty in order to file on e-line Income Tax form has not been addressed properly i.e. (a) What was purpose of converting file into micro by taking option. (b) when every think is O.K. while filling the form, the xml file is generating, puting some illogical corrections. Thus form has been made comlpicated in place of last year. Therefore, filling forms should be simlified rather making it complicated, it can be filled by CA’s or TRPs only
Due date for filing retruns for the A.Y. 2012-13 in all the cases may be extended to 31st August, 2012. As some of the individual assessees whose total income does not exceed Rs.10- lakh also prefer to file return on line, the due date may be extended to 31st August, in all the cases where due date was 31st July, 2012.
