Budget 2021- Seeks to amend notification No. 01/2017 – Customs (CVD) dated 7th September, 2017 so as to temporarily revoke the operation of the said notification for the period from 2nd February, 2021 to 30th September, 2021. Notification No. 02/2021-Customs (CVD) Dated 1st February, 2021

New Delhi, the 1st February, 2021

G.S.R. 82(E). – Whereas, in the matter of import of Certain Hot Rolled and Cold Rolled Stainless Steel Flat Products’ (hereinafter referred to as the subject goods), falling under heading 7219 or 7220 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the said Customs Tariff Act) originating in or exported from People’s Republic of China (hereinafter referred to as the subject country) and imported into India, the designated authority in its final findings vide notification No. 14/2015 – DGAD, dated the 4th July, 2017, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 4th July, 2017, had recommended imposition of definitive countervailing duty on the imports of subject goods, originating in or exported from the subject country;

And whereas, on the basis of aforesaid findings of the designated authority, the Central Government had imposed definitive countervailing duty on the subject goods vide notification of the Government of India in the Ministry of Finance (Department of Revenue), notification No. 01/2017 – Customs (CVD) dated 7th September, 2017, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub­section (i) vide number G. S. R. 1137 (E), dated the 7th September, 2017 (hereinafter referred to as the said notification);

Now, therefore, in exercise of the powers conferred by sub-sections (1) and (6) of section 9 of the Customs Tariff Act, read with rules 20 and 22 of the Customs Tariff (Identification, Assessment and Collection of Countervailing Duty on Subsidized Articles and for Determination of Injury) Rules, 1995, the Central Government hereby makes the following amendments in the said notification, namely:-

In the said notification, in paragraph 2 and before the Explanation, the following proviso shall be inserted with effect from the 2nd day of February, 2021, namely :-

“Provided that the said countervailing duty shall not be levied for the period commencing from the 2nd day of February, 2021 to the 30th day of September, 2021.”.
