Bolla Ramakrishna Vs State of Telangana (Telangana High Court)
Summary: Telangana High Court granted limited transit anticipatory bail to Bolla Ramakrishna, who apprehended arrest in connection with FIR No. 73 of 2026 registered at Cyber Police Station, Panchkula, Haryana, for offences under Sections 318(4), 319, 336(3), 338 and 340 of the Bharatiya Nyaya Sanhita, 2023. The prosecution case concerned an alleged cyber fraud in which ₹3.16 crore was transferred from the complainant firm’s account to four bank accounts, including ₹80 lakh allegedly credited to M/s. Punapureddi Pakashastralu Private Limited, in which the petitioner had been a Director.
The petitioner contended that he was a financial investor holding 50% shares, had resigned as Director in July 2026 and was not presently arrayed as an accused. He sought only temporary protection to approach the competent jurisdictional Court. The High Court noted the Supreme Court’s decision in Priya Indoria v. State of Karnataka, 2023 INSC 1008, recognising the jurisdiction to grant transit pre-arrest protection where the offence is registered outside the Court’s territorial jurisdiction.
The Court emphasised that such relief is discretionary, limited and does not decide entitlement to anticipatory bail on merits. Without determining the petitioner’s involvement, effect of his resignation or evidentiary sufficiency, the Court granted transit anticipatory bail for fifteen days on a personal bond of ₹25,000 with one surety, directed him to approach the competent Court by 28.09.2026 and imposed cooperation and non-interference conditions. The protection was directed to automatically cease on 28.09.2026 or upon intervention by the competent Court, whichever occurred earlier.
