ORDER

AMENDED ORDER UNDER RULE 10 FOR WEARING OF FACE MASK BY RAILWAY PASSENGERS

WHEREAS the Government of Maharashtra, in exercise of the power conferred under section 2, 3 & 4 of the Epidemic Disaster Act 1897 has framed Regulations for Prevention and Containment of COVID-19 under no. Corona 2020/CR/58/AROGYA-5 dtd 13TH March 2020.

AND WHEREAS under Rule 10 of the said Regulations, the Municipal Commissioner is authorized to take any measures for containment of COVID-19.

AND WHEREAS, it has been observed that after the “Mission Begin Again” was launched, many citizens are stepping out of their homes and roaming public places without wearing face mask, which is not only unsafe for their own safety but also for the fellow citizens who may come in their close proximity.

AND WHEREAS there will be gradual relaxations declared by the Government for Movement Citizens and opening of the shops, Offices and public transport including suburban railway trains there is possibility of increasing spread of virus.

AND WHEREAS it has been observed in some studies that wearing of facial mask can reduce the spread of corona virus substantially from and to person coming in contact with each other, apart from compulsory social distancing measures.

AND WHEREAS to contain the spread of the virus, I have come to the conclusion that in larger public interest, making compulsory wearing of the mask  necessary must by any person who is moving in any public place including suburban railway trains.

I, I.S. Chahal, Municipal Commissioner of Municipal Corporation of Greater Mumbai, in exercise of said powers conferred upon me, hereby direct under rule 10 of the said Regulation to implement following containment measures in the City of Mumbai —

All persons moving for whatsoever purpose and under whatever reason or authority in public places like street, office, shops, markets clinics and hospital premises must compulsorily wear face mask.

Any person travelling in public transport, including all arms of suburban railway trains, working at any site/ office/ workplace must compulsorily wear face mask.

No person, staff, officer will attend any meeting / gathering, work place without compulsorily wearing face mask.

Anybody violating this order will be punishable under section 188 of Indian Penal Code (48 of 1860) and a fine of Rs.200/- will be imposed for each such offence by the cleanup marshal or officers appointed by the Municipal Corporation of Greater Mumbai (MCGM). All these cleanup marshal or officers are hereby authorized to impose penalty against the violators. The cleanup marshals and officers are allowed to travel 24 x7 on suburban trains and in railway premises simply by carrying a valid identity document issued by MCGM for implementation of the orders. Such Marshals or officers appointed by the MCGM need not carry a valid ticket for entering the assigned railway premises and suburban trains for implementation of these orders.

These instructions must be followed very screlpulously.
