Summary: The Insolvency and Bankruptcy Board of India (IBBI), through Circular No. IBBI/CIRP/109/2026 dated 30 October 2026, has introduced a revised Form CA for submission of claims by financial creditors in a class, including real estate allottees, under the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016. The revision follows the recommendations of the Committee on Framing Guidelines for Insolvency Proceedings in the Real Estate Sector (April 2026), which observed that a simplified, allottee-specific claim form would improve homebuyer participation, facilitate claim verification and help collect project-level information for preparing the Information Memorandum and formulating resolution plans.
The revised Form CA has two parts. Part I applies to financial creditors in a class other than real estate allottees, while Part II specifically caters to real estate allottees. The latter requires details concerning the allottee’s identity, real estate project, unit or apartment, purchase value, payments made, principal and interest claimed, and possession status. It also enables allottees to indicate their preferred relief, including possession of the unit, execution and registration of a conveyance deed, refund or another specified relief. Such preferences are intended only to assist the resolution professional in collecting project-wise information and prospective resolution applicants in formulating resolution plans; they do not confer an enforceable right to the indicated relief.
The revised form must be used for claims filed on or after 30 October 2026. Claims already submitted using the earlier Form CA before that date do not require resubmission. The circular has been issued under section 196 of the Insolvency and Bankruptcy Code, 2016, and partially modifies IBBI Circular No. IBBI/CIRP/94/2026 dated 2 June 2026.

Subject: Introduction of revised Form CA for filing of claims by real estate allottees.
The Committee on Framing Guidelines for Insolvency Proceedings in the Real Estate Sector (April 2026) observed that a simplified and allottee-specific claim form would improve participation by homebuyers, facilitate claim verification, and assist in collection of project-level information necessary for preparation of the Information Memorandum and formulation of resolution plans.
