What Are the Reporting Requirements Under the POSH ACT?
As per the Prevention of Sexual Harassment at Workplace Act,2013- The Annual Report is presented to the Particular Nodal Officer by each and every office of the Company.
What are the consequences of non-compliance?
Non-compliance with the POSH Act’s Annual Report filing requirements may result in a fine of Rs. 50,000/- the first time.
If you fail to file the Annual Report under the POSH Act for the second time, you may face severe consequences, including the termination of your industry’s licenses or registrations, as well as prohibition from doing other activities.
To whom Annual report be deposited?
To The Nodal Officer of the Particular Block, Area, or Districts. Under the POSH Act, the “District Magistrate” is the Nodal Officer in most states, while the “Deputy Commissioner” is the Nodal Officer in other states.
If you don’t know who your Nodal Officer is, you can make an RTI to obtain information on the Nodal Officer for a certain Block, Area, or District.
Due date for Annual report?
The “Due Date” for filing the Annual Report with the Nodal Officer varies by state, although the POSH Act recommends that the Annual Report be filed in the calendar year, on or before 31st December.
Some states have a 31st January deadline, whereas others have a 31st December deadline. However, the corporation should file its Annual Report on or before 31st March.
Why March 31st is the due date?
Because the firm’s annual accounts are closed on this day, the company is then audited by auditors. Most of the time, the auditor will inquire whether or not the POSH Act has been followed. As a result, on or before March 31st, one must comply with the same.
Note – a hard copy of the Annual Return is sent to the Nodal Officer of the Block, Area, or District, along with a cover note. If you are unable to submit your Annual Report online, you may use post office services and send it via registered mail.
