CA Sandeep KanoiIt seems that whole world is against Chartered Accountants and like Prime Minister Narendra Modi they are also answerable for anything happening in Tax or Finance world, even if they are involved or not.

It is observed that Chartered Accountants are been taken as most soft target by Politician, Bureaucrats and also by Tax Authorities.  A few days back Delhi CM Arvind Kejriwal has alleged while addressing the tax professionals at a programme organised by Delhi Sales tax Association that Chartered Accountants promote corruption in System, but after protest by CAs present at the venue he has taken his words back.

In a series of attacks on Chartered Accountants latest is been alleged by A CA from Pune that he has been slapped by a Service Tax Official when he visited his office with his Assistant and client in respect of reset of password of his clients Service Tax Account on online portal of Service Tax Registration.

Service Tax IncidentAfter the incident CA from Pune has approached the Pimpri-Chinchwad (Pune) Branch of Institute of Chartered Accountants of India (ICAI) and they have written a letter on 16th October 2015 to the Additional Commissioner of Service tax, Pune and demanded immediate action against the erring officer who is Posted as Service tax Superintendent in Akurdi (Pune) office of Service tax Department.

CA Nitesh More from Kolkata who has started the an online petition against the alleged slapping on the popular petition website change.org has  condemned the incident and urged fellow CA Professional to unite and take the matter to higher level so that justice can be imparted and repetition of such incidence can be stopped in future. He further commented that these are the tactics which are been used from years to create fear among professionals. CA. Devendra Kumar Somani”from  Udaipur said that “It is a matter of great concern for we all. Since a long CA fraternity is known for its independence and integrity. We are partner in national building. We are known for our services world-wide. Those who are jealous, envious and selfish, alleges CAs in their self-interest. We are knowledgeable but polite and generous. That does not mean we are weak. We strongly condemn such incidences. Friends, it is a time to wake up. Let us unite and teach a lesson to erring class. They should not forget that we are strong pillar of economic development.Persons at the helm should take note of this. I appeal to the CA fraternity to strongly condemn such incidences so that the same are not repeated in future.

Chartered Accountants and other professionals from Across the India has strongly condemned the alleged incident. Some of the comments made by them on changes.org are as follows:-

Ashok Kothari has commented that “It is criminal offense committed by the authority. FIR should be lodged against said authority. Complaint to CVC and CBI should also be filed. ………. We are one of the pillars for curbing the corruption and a helping hand to Govt. for proper accounting, correct and timely furnishing returns, payment of taxes and so many other works which has kept the financial discipline in the country. “

Manish Kumar commented that “It is attack on our professional dignity”

CA Rajesh Pabari from Mumbai said that it’s highly unprofessional act from department.

It is a very well known fact that Chartered Accountants are always harassed for any matter of financial irregularity of his client.

Government should do something to keep in check its officers and to make them actually treat Assessee and his consultant as Customer instead of treating them as second class citizens.

Being a Chartered Accountant I hope that there will be ACCHE DIN for us too and dignity and respect of profession will be maintained.

    Why hasnt the CA filed a Police complaint? He can go to the court directly as he is having two witnesses to the incident.
    Let that Officer visit the Courts..

    What stand ICAI HO is going to take in this matter, probably nothing. The office bearers are not interested in protecting the profession and members which we have witnessed recently in getting extension for tax audit. ICAI can’t take the claim of getting the extension. We understand they are the only beneficiaries by becoming council members. Members should adopt democratic protest by not electing such members. Perhaps NOTA has implemented in council elections, members could use it.

      I could see this coming! no wonder with our spineless institute asking FM and CBDT for extension for IT filing beyond 30th Sept and getting the door shown (though it was extended with High courts orders and that too on 1st Oct). I think the CA fraternity itself has to blame for lack of group support, had this event happened with an advocate being slapped, one should have seen the consequences, the ST office would have been closed for days if not years till the ST official was thrown behind bars with the entire department standing in line for offering apology. But CA fraternity is too gentleman for all this, not even one person will physically stand, nor give a dharna in front of ST office, because we are GENTLEMEN. AND anyone can tell us anything, including aiding the corrupt, creating tax avoidance, encouraging black money and what not. But they conveniently forget that the day CAs decide to put down their pen, the entire financial system of the country will be on its knees, though today our representative themselves are on knees in front of the bureaucrats for god known reasons. I was wondering what prevented CA institute from telling the FM or CBDT that if they decide not to listen to CA fraternity, then we will go for a system bycott for filing as a mark of protest of the disrespect shown to the institute. But then we have people at the helm who know better than what all of us know!! May god bless us all and open the eyes of those at helm of affairs, before it is loo late. We have already accepted provisions of IT act and Companies act labelling us as defaulters for clients’ faults (wonder whether Advocates should have been so labelled if their clients are found at fault), so days are not far, when Govt would prefer gentleman CAs to go behind bars for all and sundry defaults, just because the clients will manage, while the CAs would suffer.

    that officer must be suspended as we should unite and fight for the benefit of representatives of the tax payers. We work as professionals the department must understand our concern and must respect the professionals…

    Absolutely wrong and CA should make a FIR and if it not accepted should make NC and file a Case in the Court a deterring action needed to warn others also.

    This is a highly condemnable Act on the part of the Official. What authority he has to slap the CA. He has no authority to slap any body leave alone CA. This atrocious behaviour is due to the fact that we are docile, soft spoken and have no unity among ourselves and our apex body does not take care of us as members. If such incident has happened to any advocate brother the entire bar would have stood by him and the bar-council would have brought heaven down. But our brothers are busy with their own works and will not even come out for the fear of repression. If dignity and independence of the profession has to be maintained we should be bold enough to come out and support our brothers when such incidents occur. Let us pray to the conciousness of our Council members both at regional and central level to take up the issued with concerned authorities and see that the culprit is brought to book and is duly punished. Probably the official being from Minority community feels that no Government can take any action against him.

    this is a very serious matter and we have to take very hard action against that officer (Govt Servent), in fact the that officer should have suspend because of their bad behavior in public place.

    I think a day is not far when first time we will see chartered accountants will call bandh, start morcha tactics and go for hunger strike.
    In the name of democracy if others can do this, why chartered accountants can not?

    Dear Sir,
    This matter is extremely serious and a tight big slap on the CA fraternity.I suggest this matter be taken up through ICAI Delhi with the Finance Ministry and Reveue Secretary Maharashtra so that JALIL SHAIKH is transferred to a place like Nagaland or Arunachal Pradesh and becomes a lesson for others so that another JALIL SHAIKH is not born tomorrow and such incidents do not occur in future,which can demoralise the CA fraternity.List is enclosed.

    This is really a worst thing happens to a professional. The officer in default should be punished so that this could become an example for all other so that they have to think twice before doing such wrong and unethical thing.

    Also now its enough from ICAI if this body have any power so please use other wise people and government all have loose respect for this profession and all other slimmer profession like advocates, CS’s, CWA’s will soon overcome our profession.

    Acts like this should be opposed and should be taken care by the higher officials of the Institute with full force and a strong message should be sent to people against the CA fraternity that such acts will not be tolerated and will be replied in the strongest way possible.

      matter should also be complained before Human Right Commission.Writing asoft complaint untill strong action is against erring officers will not solve the purpose. A committee of few chartereds should be formed, who rigiourously follow the matter.In this complaint no cc has been made to our institute President.Neither he has been requested to talk to Finance Minister.Inhuman behaviour of officers are beyond tolerance.
