Minimum government and maximum governance is surely a welcomed initiative. With an objective of achieving the ease of doing business in the country and to fast-tack the hindered projects, NDA government has launched various campaigns. ‘Start-up India’ and ‘Make in India’ have been the recent initiative. DIPP issued press note no. 12 dated 24th November, 2015 (shall come into effect immediately) thereby liberalising FDI in favour of 15 major sectors.
Thus, the question involved in the present writ petitions has been considered by the Supreme Court in number of occasions clearly holding that a person whose name appears in the select list does not acquire any indefeasible right of appointment and empanelment at the best is a condition of eligibility for the purpose of appointment and by itself does not amount to selection or create a vested right to be appointed.

In a major step, the organization has clarified that student trainees who are paid stipend during on the job training while pursuing course in technical /professional educational institutions would not come under the definition of employee for the purpose of EPF &MP Act. This removes the ambiguity surrounding the eligibility of such student-trainees for enrolling as members of the Fund and is expected to bring about greater clarity among employers and also reduce litigations.
