K. Gopi Vs Sub-Registrar & Ors. (Supreme Court of India)
Supreme Court clarifies Sub Registrar’s limited authority in assessing vendor’s title under the Registration Act
The Supreme Court of India recently delivered its judgment in the case of K. Gopi vs. The Sub-Registrar & Ors., Civil Appeal No. 3954 of 2025, on April 7, 2025. This case addresses the authority of Sub-Registrars under the Registration Act, 1908, particularly concerning their power to refuse registration based on the title verification of the vendor.
Background:
- On September 2, 2022, a sale deed was executed by Jayaraman Mudaliyar in favor of the appellant.
- The Sub-Registrar refused to register this sale deed, prompting Appellant to file a writ petition, which was dismissed.
- Appellant then appealed to the District Registrar, who, on September 4, 2023, directed the Sub-Registrar to reconsider.
- Despite this, the Sub-Registrar again refused registration on October 3, 2023, citing insufficient proof of the vendor’s title.
- Subsequent writ petitions and appeals by Appellant were dismissed by both the Single Judge and the Division Bench of the Madras High Court.

Analysis:
- The Court examined whether Rule 55A(i) of the Registration Rules, framed under the Registration Act, 1908, grants Sub-Registrars the authority to refuse registration based on doubts about the vendor’s title.
- The appellant contended that the Registration Act does not empower Sub-Registrars to assess the validity of a vendor’s title and that Rule 55A(i) is ultra vires to the Act.
- The respondents, represented by the Advocate General for Tamil Nadu, indicated willingness to proceed with the registration without delving into the legal challenge of Rule 55A(i).
