 In the case of Vedabai @ Vaijayanatabai Baburao Patil vs. Shantaram Baburao Patil and Others, the Supreme Court dealt with the dismissal of an appeal due to a seven-day delay in filing, which had been rejected by the Additional District Judge, Amalner, and upheld by the Bombay High Court. The appellant had cited illness as the reason for the delay, and though the delay was minor, the appellate court dismissed the application, faulting the timing of the certified copy request and questioning the illness claim. The Supreme Court found that the lower courts failed to consider the court vacation during the period and the appellant’s prompt filing once she recovered.

The Supreme Court emphasized adopting a pragmatic and liberal approach in applying Section 5 of the Limitation Act, especially in cases involving minimal delays. It noted that the principle of advancing substantial justice outweighs procedural technicalities, and minor delays should not be penalized if sufficient/Reasonable cause is shown. The Court cited prior judgments, including State of West Bengal v. The Administrator, Howrah Municipality and Smt. Sandhya Rani Sarkar v. Smt. Sudha Rani Debt, to stress the importance of interpreting ‘sufficient cause’ broadly. Setting aside the orders of the High Court and the Additional District Judge, the Supreme Court condoned the delay, restored the appeal for adjudication on merits, and reinforced the judiciary’s responsibility to prioritize justice over procedural constraints.
