Indian Flexible Intermediate Bulk Container Association Vs Director General Of Foreign Trade (Delhi High Court)

Delhi High Court held that the notification dated 29th January 2020, retrospectively revoking the benefit under the Merchandise Exports from India Scheme (MEIS) in respect of Flexible Intermediate Bulk Container bags, with effect from 7th March 2019, is unjustified and unsustainable in law.

Facts-

The Petitioner has approached this Court under Article 226 of the Constitution of India, challenging the notification dated 29th January, 2020, published by Department of Commerce, Ministry of Commerce and Industry, Government of India. In the said notification, Respondent No. 1- Directorate General of Foreign Trade, has retrospectively revoked the benefit under the Merchandise Exports from India Scheme in respect of Flexible Intermediate Bulk Container bags, with effect from 07th March, 2019.
