Changes In Application For Registration Of Company- Message From Ministry Of Corporate Affairs

WHAT POINTS TO BE NOTED:

1. As part of Government of India’s Ease of Doing Business (EODB) initiatives, the Ministry of Corporate Affairs would be shortly notifying & deploying a new Web Form i.e. ‘SPICe+’ (pronounced ‘SPICe Plus’) replacing the existing SPICe form(used for Registration of Company).

So, RUN form, E-MOA (E Form 33), E-AOA (E Form 32), E-Form Agile (E Form 34) will be scraped for registration of Company, once web form SPICe+ deployed on MCA portal.

2. SPICe+ (would be an integrated Web form offering multiple services) and the services will be as follows:

a. Name reservation,

b. Incorporation,

c. DIN allotment,

d. Mandatory issue of PAN, TAN, EPFO, ESIC, Profession Tax (Maharashtra) and Opening of Bank Account.

e. Allotment of GSTIN, if applied.

3. Once notification passed and SPICe+ deployed, we have to use that only for all services mentioned in point number 2.

4. Due to above changes stakeholders can not file web form RUN (used for name application) for resubmission w.e.f. 01/02/2020 onwards that too approximately 15 days, due to this following three question arises-

a. Can we make new name application by web form RUN?

ANS: No, wait for deployment of SPICe+ web form and apply through it, once deployed, till that no new application can be made, however we can use existing eform Spice for registration of Company.

b. When we can file web form RUN for resubmission came before 01/02/2020?

ANS: Yes, can resubmit after 16/01/2020 (as mentioned approximately 15 days from 01/02/2020 by MCA).

c. What will be effect conclusively?

i. New web form SPICe+ will be deployed.

ii. Web form RUN for name application cannot be used from 01/04/2020 to till 15 days as stated in MCA message.

iii. We can use existing e form Spice(for company registration) along with linked eforms untill new web form SPICe+ deployed by MCA.
