Public Notice No. 22 (RE-99)/1997-2002, issued on July 8, 1999, by the Ministry of Commerce, amends Public Notice No. 274(PN)/92-97 dated February 23, 1995. In accordance with the powers conferred under the Export and Import Policy, the Director General of Foreign Trade (DGFT) adds an explanation to clarify that the term “aircraft and helicopters” now includes used or second-hand aircraft and helicopters for the purposes of the policy. This clarification aims to ensure that used aircraft and helicopters are subject to the same regulations as new ones in the export and import process. The amendment seeks to provide clearer guidelines for the export and import of these goods, including second-hand models, aligning with broader trade practices. The notice was issued in the public interest.

In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II-Section 3 – Sub-section (ii) vide S.O. No. 83(E) dated 31.3.1997, the Director General of Foreign Trade hereby amends paragraph (2) of Public Notice No. 274(PN)/92-97 dated 23-02-95 namely-
The following Explanation shall be added after paragraph 4 thereof:
“Explanation.
For purpose of this Public Notice, this expression “aircraft and helicopters” appearing therein shall be deemed to include used/second-hand aircraft and helicopters.”
