Karnani Resources LLP Vs Directorate of Enforcement & Ors. (Calcutta High Court)

The Calcutta High Court heard a writ petition seeking directions restraining respondent nos. 1 to 4 from obstructing, hindering, or preventing respondent no. 5 from vacating the demised premises and delivering vacant and peaceful possession to the petitioner. Counsel for respondent no. 5 submitted that, owing to unavoidable reasons and police deployment, respondent no. 5 had been unable to vacate the premises earlier but was ready and willing to hand over peaceful possession so that the petitioner could lease or otherwise utilise the premises.

The learned ASGI placed on record an email dated July 2, 2026 stating that the Enforcement Directorate had conducted proceedings under Section 17 of the Prevention of Money Laundering Act, 2002 at the office premises of Indian PAC Consulting Pvt. Ltd. on January 8, 2026, which resulted in nil seizure due to certain external interference. The Enforcement Directorate stated that it had no objection to the premises being vacated and the furniture and fixtures being removed, subject to compliance with the Supreme Court’s order dated January 15, 2026 in Writ Petition (Criminal) No. 16 of 2026. Respondent no. 3 also filed a report stating that it had no objection to the premises being vacated and the furniture or fixtures removed, subject to compliance with the same Supreme Court order.
