Malkeet Singh Gill Vs State of Chhattisgarh (Supreme Court of India)

The Supreme Court, in Malkeet Singh Gill Vs State of Chhattisgarh, dismissed the appeal challenging the conviction of the appellant arising from a scheme operated by Revanchal Vitta and Commercial Vikas Limited Company. The case concerned allegations that the company collected deposits from members of the public through agents by representing itself as a legitimate financial entity and promising annual returns of 8–10 percent. Depositors were issued passbooks, ledger entries, and receipts. However, when the deposits matured, the company failed to refund the amounts along with the promised interest and eventually ceased operations. Complaints alleged that depositors had been induced to invest on the basis of false representations, including claims that the company was recognised by the Reserve Bank of India.

Following investigation, offences under various provisions of the Indian Penal Code were added. The Trial Court framed charges under Sections 409, 420, 467, 468 read with Section 120-B IPC and examined 24 prosecution witnesses. After evaluating the evidence, it convicted the accused under Sections 409, 420, 409 read with Section 120-B, and 420 read with Section 120-B IPC, while holding that the charges under Sections 467 and 468 had not been established beyond reasonable doubt. The Trial Court imposed separate sentences for each offence and directed that they run consecutively. The Appellate Court upheld both the conviction and the sentences.
