In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government makes the following additions to the list of ports mentioned in Para 2A of Notification No. 38(RE-2007)/2004-2009 dated 15.10.2007 as amended from time to time
Consequent upon the ban/restriction imposed as above, it is hereby clarified that exports under transitional arrangements as provided under Para 1.5 of the Foreign Trade Policy, 2004-09 shall not be permitted. This is in force with the issue of Notification No.77 dated 7.2.2008. That is since 7.2.2008, no exports are allowed under transitional arrangements.
It is hereby clarified that in terms of Para 3(i) of the aforesaid Policy Circular, the last date for making applications would be 31st of July for each licensing year. Thereafter, further applications would be considered on “first come first served” basis, provided the earmarked quantity has not been exhausted.
In exercise of the powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby deletes with immediate effect Paragraph 2.4 of Notification No. 38 (RE-2007)/2004-2009 dated 15.10.2007 as amended from time to time, which was inserted vide Notification No. 46 (RE-2007)/2004-2009 dated 2.11.2007.

Further in order to enable supporting manufacturers, whose names appear in the shipping bills, to import directly, Licensing Authority concerned shall endorse the names of such supporting manufacturers on the certificate as co-licensees.
It has since been observed that some of Regional Authorities have been sending the request for extension of block of years to the Headquarters. In this regard, reference is invited to the provisions contained in Para 5.11 of HBP whereby Regional Authorities have been authorized for considering the request for extension in export obligation period. The issues relating to extension in Export Obligation period and extension in block of years are thus interlinked and hence have been re-examined.
