Notification No. 108 (RE-2010)/2009-14 Export of 5,000 bales of Assam Comilla Cotton will be exempted from any export restrictions during the current cotton season (up to 30.09.2012) subject to registration with DGFT. Registration Certificate for such exports will be valid for 30 days only.
Supplies to non mega power projects were entitled to benefits for Deemed Exports only under Para 8.3(a) of FTP, viz., Advance Authorisation / Advance Authorisation for annual requirement / DFIA. It has now been decided that supply to non mega power projects shall not be entitled to any deemed export benefit. When the annual supplement to FTP is brought out, the consequential changes of this decision will be reflected in various provisions of chapter 8 of FTP & also HBP vol. 1.
Trade Notice 24 dated 20th March, 2012 Through Public Notice No. 102 dated 16.03.2012 procedure for scrutiny and revalidation of Registration Certificates(RCs) for export of cotton were notified. Last date stipulated in this Public Notice for submission of applications for revalidation of RCs with the concerned RAs is Thursday, 22nd March, 2012. It is expected that the trade would have taken expeditious action for submitting the applications.
In exercise of the powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2004-2009, as amended from time to time, Director General of Foreign Trade, in pursuance of Notification No. 106 (RE-2010)/2009-14 dated 12.03.2012, notifies the procedure/guidelines for scrutiny and revalidation of Registration Certificate(RCs) for export of cotton [ITC(HS) code 5201 & 5203].
Procedure of obtaining Registration Certificate (RC) was notified in Notification No. 63 (RE-2010)/2009-14 dated 04.08.2011 and modified by Notification No. 74 (RE-2010)/2009-14 dated 12.08.2011. Time to export (validity of RC) was “30 days from issue of RC”. Because of prohibition imposed by Notification No. 102 (RE-2010)/2009-14 dated 05.03.2012, this time limit may require to be extended in respect of those RCs, that were valid as on 05.03.2012 and for which LEOs are yet to be issued & exports completed. All RCs would need to be submitted to DGFT for scrutiny and revalidation. Exports can be effected only after RCs are revalidated.
Roll Back of Ban on Cotton Exports The Cotton Budget for the cotton year 2011-12 was prepared by the Cotton Advisory Board. In arriving at a Cotton Export Policy a balanced perspective is taken, carefully addressing the interests of all stakeholders including farmers, traders, yarn producers and the apparel industry.
CBEC sends data on exports to DGCIS daily that is generated out of their daily trade reports (DTRs), which is based on LEOs (Let Export Orders) issued that day. Hence any consignment in respect of which LEO has been issued gets reported as having been exported. Accordingly, consignments for which Let Export Orders (LEOs) have been issued till 2400 hours on Sunday, 04 March, 2012 will be outside the purview of Notification No.102 dated 05 March, 2012 cited above.
At the time of issuance of DFIA: Ensure that the exporter has given the details with regard to technical characteristics, quality and specifications in the application for DFIA (as at Sl. No. 15 of ANF A-H). RA should specify the details of technical characteristics, quality and specifications of such items in the DFIA.
Notification No.105 (RE-2010)/2009-2014 In respect of exports to Iran, export proceeds realized even in Indian rupees will be eligible to avail export benefits and incentives.
In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No. 22 of 1992) read with paragraph 2.1 of the Foreign Trade Policy, 2009-2014, as amended from time to time, the Central Government hereby amends Notification No. 87(Re-2010)/2009-14 dated 05.12.2011 as follows.
