The Protocol was signed at Port Louis on 7 March 2024 and entered into force on 10 August 2026, following completion of the required procedures by both Contracting States. The notification, issued under section 159(1) of the Income-tax Act, 2025 (30 of 2025), provides that all provisions of the Protocol shall be given effect to in India in accordance with Article 3 of the Protocol. The amendments replace the Convention’s existing Preamble with language expressly addressing the elimination of double taxation without creating opportunities for non-taxation or reduced taxation through tax evasion or avoidance, including treaty-shopping arrangements intended to benefit residents of third jurisdictions indirectly. The Protocol also introduces Article 27B, titled “Entitlement to Benefits”, after Article 27A. Under the new provision, a benefit under the Convention shall not be granted in respect of an item of income where, having regard to all relevant facts and circumstances, it is reasonable to conclude that obtaining the benefit was one of the principal purposes of an arrangement or transaction that resulted directly or indirectly in that benefit. An exception applies where granting the benefit would be consistent with the object and purpose of the relevant Convention provisions.
