In response to an unstarred question in the Rajya Sabha, the Minister of State for Finance provided details on corporate tax issues for the last five years. The government has issued 7,097 prosecution notices and launched 1,797 prosecutions against companies for non-payment of corporate tax from FY 2019-20 to FY 2024-25. However, the government refrained from disclosing specific company names due to confidentiality requirements under the Income-tax Act. The government has not written off corporate tax for any companies during this period. A detailed annexure lists the state-wise corporate tax collection for the last five years, with Maharashtra and Delhi contributing the highest amounts. The total corporate tax collected across all states and foreign entities amounted to ₹8,57,750.36 crore for FY 2023-24.

NON-PAYMENT OF CORPORATE TAX

  1. SHRI ABDUL WAHAB:

Will the Minister of FINANCE be pleased to state:

(a) whether Government has sent notice or sued any company in the past for not paying the corporate tax in the last five years;

(b) if so, the details of such companies who have received notice or sued by Government in the last five years;

(c) the details of corporate tax collected in the last five years by Government, year-wise, company-wise and State-wise;

(d) whether Government has written off corporate tax of any companies in the last five years; and

(d) if so, the details of the companies and the amount that has been written off, year-wise?

(a) Yes, Sir.

(b) The company-wise details cannot be provided since disclosure of information in respect of specific taxpayer is prohibited except as provided under section 138 of the Income-tax Act, 1961. However, the number of prosecution notices issued against corporates/companies during the last five years i.e. from FY 2019- 20 to FY 2024-25 is 7,097 and the number of prosecutions launched against them is 1,797.

(c) The details of corporate tax collected in the last five years by Government, year-wise and State-wise are at Annexure A. Further, the company-wise details are not provided since the disclosure of information in respect of specific taxpayer is prohibited except as provided under section 138 of the Income-tax Act, 1961.

(d) No, Sir. Government has not written off corporate tax of any company in the last five years.

(e) In view of (d) above, the question does not arise.
