AIR Cash Deposit Alone Not Enough for Reopening; Contradictory “Reasons to Believe” Quash Reassessment – ITAT Delhi
The Delhi Bench of the ITAT, in Sh. Atar Singh vs. ITO, Ward-1(1), Faridabad (ITA No.2732/Del/2025, AY 2012-13, order dated 19-12-2025), quashed the reassessment proceedings initiated u/s 147/148, holding that the “reasons to believe” were contradictory, vague and reflected complete non-application of mind.
The Tribunal noted that the AO reopened the assessment solely on the basis of AIR information of cash deposits of ₹95.23 lakh in the assessee’s bank account. In the recorded reasons, the AO stated at one place that the assessee had not filed any return of income, while elsewhere alleged that the income declared did not commensurate with the cash deposits—a clear internal contradiction showing uncertainty on basic facts. The AO also failed to carry out any independent analysis of the bank entries or establish a live link between the cash deposits and alleged escapement of income.
ITAT held that mere cash deposits reflected in AIR data cannot, by themselves, justify reopening, and reopening based on such mechanical reliance amounts to reopening on suspicion. Relying on several coordinate bench and High Court decisions, the Tribunal concluded that the reassessment was initiated on incorrect assumptions, non-existent facts and without application of mind, rendering the sanction and reopening invalid in law.
Accordingly, the ITAT set aside the reassessment order and the CIT(A)’s order, quashed the reopening proceedings, and deleted the entire addition. Other grounds on merits were rendered academic and not adjudicated
