Sett Dey And Co Homoeo Lab (GST AAR West Bangal)

The applicant, Sett Dey and Co. Homoeo Lab, manufactures medicaments, including those used in Ayurvedic, Unani, Siddha, Homeopathic, or Bio-chemic systems, either consisting of a single constituent or two or more constituents mixed for therapeutic or prophylactic purposes. These medicaments are prepared exclusively in accordance with formulae described in authoritative books listed in the First Schedule to the Drugs and Cosmetics Act, 1940, or in homeopathic pharmacopoeias of India, the USA, the UK, or Germany. The applicant sought an advance ruling under Section 97(1) of the GST Act regarding the appropriate HSN codes and full GST rates for these products.

The applicant stated that it charges GST at 5% for single-constituent medicaments under HSN 30039014 and at 12% for multi-constituent medicaments under HSN 30049014, based on Schedule I of Notification No. 34/2017-Central Tax (Rate). The applicant requested clarification on the correct HSN classification and applicable GST rates.

The Revenue did not express any view on the matter. The AAR examined the nature of the products and relevant GST provisions. The authority considered the post-amendment Schedule I under Notification No. 09/2025 – Central Tax (Rate), which specifies that medicaments manufactured exclusively as per authoritative books or pharmacopoeias and sold under the names specified therein are taxed at 2.5% CGST + 2.5% SGST.
