 PUBLIC NOTICE NO. 47 (RE-2001)/1997-2002

NEW DELHI,  THE   5th NOVEMBER, 2001

Attention is invited to the entry at ITC (HS) Code No.3301 in Table B of Schedule 2 and S.No.33 of  Appendix I to Schedule 2 of the Book Titled ‘ITC(HS) Classifications of Export and Import Items, 1997-2002 (incorporating amendments made upto 31.8.1998)’ and as amended from time to time prescribing the conditions for export of sandalwood oil.

2. In exercise of the powers conferred under Paragraph 4.11 of theExport and Import Policy, 1997-2002, (incorporating amendments made upto 31.3.2001) and as amended from  time to time,  the Director General of Foreign Trade hereby allocates the quantitative ceiling for the export of Sandalwood Oil for the financial year 2001-2002 and prescribes the procedure to be followed in this regard as follows:-

 (i) The overall ceiling of Sandalwood Oil to be permitted  for export for the financial year 2001-2002 shall be 13 MT with allocation to categories of exporters as under:-

(a)   A quantity of 3 MT of Sandalwood Oil is earmarked for export by Tamilnadu Forest Plantation Corporation Ltd., Tamilnadu, a PSU of Government of Tamilnadu (TAFCON).

(b)   A quantity of 10 MT of Sandalwood Oil is earmarked for export by private exporters out of the material purchased through Government auctions.

 (ii) Only the Sandalwood Oil distilled from two classes of Sandalwood viz. Sandalwood Root Class and Ainchilta Class procured directly from the State Forest Department shall be permitted for exports.

3. The Director General of Foreign Trade, New Delhi further prescribes following procedures for aforesaid export:

(i) The Director General of Foreign Trade shall issue authorisation to eligible  exporters for export of sandalwood oil.

(ii)   Prospective exporters shall submit their application in the form given in Appendix 18 A alongwith Appendix 1 A of the Handbook of Procedures, 1997-2002 within thirty days (30 days) from the date of issue of this Public Notice to the DGFT (Headquarters Office), Udyog Bhavan, New Delhi.

(iii)    The application shall be accompanied by the following documents:-

(a)   A copy of the valid export order/irrevocable Letter of Credit from the foreign buyer;

(b)  Exporters should submit copy of Legal Procurement Certificate(s) issued by the Principal Chief Conservator of Forests of the concerned State showing the procurement and availability of Sandalwood Root Class/Ainchilta Class with the exporter in the format as prescribed at Annexure I to this Public Notice.

(iv) Application received within the stipulated period would be considered by the Export Facilitation Committee of DGFT on merit in consultation with Ministry of Environment & Forests for issue of authorisation for export of Sandalwood Oil and  shall be subject to any  other condition that may be stipulated. The export price indicated in the confirmed Export Order/irrevocable Letter of Credit shall be one of the factors to be taken into consideration for issue of authorisation.

(v) The authorisation to the eligible exporters for export of Sandalwood Oil shall be issued by the Headquarter Office of  DGFT only after the exporter produces the Certificate of Physical Verification of Stocks from the Regional Deputy Director (Wildlife) in case of Delhi/Mumbai/Kolkata and Chennai or  Deputy Conservator of Forests of the concerned Territorial Division.

(vi) At the time of issue of authorisation, the exporters shall produce the Original Legal Procurement  Certificate complete in all respects of Sandalwood Root/Ainchilta Class to D.G.F.T., Udyog Bhavan, New Delhi for an endorsement to the effects that against the said Legal Procurement Certificate(s)/ Certificate(s) of Origin, an authorisation for export of the quantity of Sandalwood Oil as specified on the said authorisation has been issued.

(vii) Export of Sandalwood Oil against the authorisation so issued shall be completed within six months from the date of issue of authorisation.
