Amendments in Schedule-I (Imports) to the ITC (HS) Classifications of Export and Import Items, 2004-09

NOTIFICATION No. 89 (RE-2008)/2004-09

S.O. (E).- In exercise of powers conferred under section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy, 2004-09, the Central Government hereby makes the following amendments in Schedule-I (Imports) to the ITC (HS) Classifications of Export and Import Items, 2004-09:

1. Import Licensing Note No, (2) inserted at the end of Chapter 25, vide Notification No. 17 (RE-2007)/ 2004-09 dated 26th July 2007, as amended from time to time, will be amended to read as follows:

“Import of marble will be subject to the conditions laid down in Policy Circular No.12 (RE-08)/2004-2009 date 27.06.2008, Policy Circular No.13 (RE-2008)/2004-09 dated 30.6.2008, Policy Circular No.20(RE-2008)/2004-09 dated 16.07.2008, Policy Circular No.25 (RE-2008)/2004-09 dated 08.08.2008, Policy Circular No. 28 (RE-2008)/2004-09 dated 20.08.2008 and Policy Circular No. 65(RE-2008)/2004-09 dated 26.02.2009“.

2. Import Licensing Note inserted at the end of Chapter 68 vide Notification No.47 (RE-2008)/2004-09 dated 10.10.2008 shall be amended to read as under:

“(1 ) Import of rough / unprocessed blocks and slabs of agglomerated / artificial stones shall be subject to the conditions laid down in Policy Circular No.34(RE-08)/2004-2009 dated 10.10.2008 and Policy Circular No. 35(RE-2008)/2004-2009 dated 10.10.2008 and Policy Circular No. 66(RE-2008)/2004-09 dated 26.02.2009“.

3. This issues in public interest.

Policy Circular No. 66(RE-08)/2004-2009

All Commissioners of Customs;

Sub: Guidelines for import of Rough Blocks and Slabs of agglomerated / artificial stones for the year 2008-09.

Attention is invited to Policy Circular No.34(RE-08)/2004-2009 dated 10.10.2008 on the subject mentioned above.Vide the Circular, licences for import of aforementioned items have been issued to eligible entities.

2. Representations have been received from the Association of eligible entities who received the licences for rough blocks/slabs of agglomerated/artificial stones stating that on account of slow down in the economy and real estate sector, demand for agglomerated/artificial stones has temporarily come down very significantly. Accordingly, Association has requested that for the said allotted quota, the licence holders may be provided an option to import either the items indicated in the licence or rough marble blocks/slabs as detailed in Policy Circular No.13 ((RE-08)/2004-2009 dated 30.6.2008.

3. The matter has been examined and the request of the Association has been agreed to by the competent authority. Accordingly, it is clarified that all licence holders of rough/ unprocessed blocks and slabs of agglomerated/artificial stones, issued to them as per provisions of Policy Circular No.34 dated 10.10.2008 are hereby given an option to either import rough marble blocks/slabs (Exim Code Nos. 25151100, 25151210, 25151220, 25151290 indicated in Schedule-1 (imports) of ITC (HS) Classifications of Export and Import Items, 2004-2009) or the items indicated in their licenses, i.e. artificial/agglomerated stones. The import of rough marble blocks/slabs under these licences, if any, shall be subject to all the conditions including floor prices, among others, as applicable on import of rough marble blocks/slabs notified by the Government. Eligible entities may approach the RA concerned for getting an endorsement to this effect made on their licences within a period of 15 days from date of issue of this Circular.

4. This issues with the approval of Competent Authority.

Sub: – Guidelines for import of Rough Marble Blocks and Slabs for the year 2008-09.

Attention is invited to Policy Circular No.13 (RE-08)/2004-2009 dated 30.6.2008 on the subject mentioned above. Representations have been received from trade and industry, who have been granted licences for import of rough marble blocks/slabs for the year 2008-09 under the aforementioned Policy Circular. The representations state that on account of Parliamentary elections, the new Policy for import of rough marble blocks/slabs for the year 2009-10 is likely to be delayed. This delay is likely to cause disruption in their business. They have further requested that they may be allowed to import a quantity equivalent to 25% of the licences granted to them for the year 2008-09, so that their business needs of the first three months of the next financial year are met.

2. The representations have been examined and with the approval of competent authority, it is informed that the request of the Association has been agreed.

3. Accordingly, all licence holders of rough marble blocks/slabs, issued to them under the provisions of Policy Circular No.13 (RE-08)/2004-2009 dated 30.6.2008, may apply to the concerned R.A. of DGFT for enhancing the quantity in their licence by upto 25% of the quantity granted to them in the year 2008-09. The import of enhanced quantity shall be subject to all the conditions applicable on import of rough marble blocks/slabs indicated in relevant Circular. It is also informed that the utilization of the additional quantity and actual import may only be made after 1.4.2009. An endorsement to this effect shall be made on the licence by the R.A. concerned.

4. This issues with the approval of Competent Authority.
