Competent Authority Calcutta Vs David Mantosh & Ors. (Supreme Court of India)

Summary: The Supreme Court held that the jurisdiction of the Civil Court was impliedly excluded in relation to land subjected to proceedings under the Urban Land (Ceiling and Regulation) Act, 1976. The dispute concerned premises at Canal Circular Road, Calcutta. M/s Orient Beverage Ltd. had filed a statement under Section 6(1) of the Act and, following the statutory proceedings, the suit property vested in the State of West Bengal under Section 10(3). Possession was subsequently surrendered and the State allotted the land, along with adjoining land, to Apollo Gleneagles Hospitals on a long-term lease.

The plaintiffs subsequently instituted a civil suit seeking, among other reliefs, declarations that the proceedings and notifications under the Urban Land (Ceiling and Regulation) Act, 1976 were null and void and that they were owners entitled to possession of the suit property. The Trial Court dismissed the suit, but the Calcutta High Court reversed that decision and decreed the suit.

The Supreme Court examined the statutory scheme and the Constitution Bench decision in Dhula Bai vs. State of MP (AIR 1969 SC 78). It observed that the Act constituted a self-contained code, provided appellate remedies, accorded finality to specified orders, contained overriding provisions and expressly excluded civil-court jurisdiction in specified matters. Applying the tests in Dhula Bai, the Court held that civil-court jurisdiction over the proceedings in question was excluded by necessary implication.
