Jaskaran Jeet Singh Deol Vs State of Punjab (Supreme Court of India)
Illegal Arrest Cannot Be Repeated at Police Discretion; Departmental Inquiry Mandatory Against Erring Officers: Supreme Court Lays Down Strict Re-Arrest Safeguards
Re-Arrest After Constitutional Violation Requires Judicial Approval
The Supreme Court has held that an accused released because of violations of Articles 22(1) and 22(2) of the Constitution may be re-arrested for the same offence only after complying with strict constitutional and judicial safeguards.
The Court further directed that where an arrest is declared unconstitutional, the superior police authority must transfer the investigation to another officer and initiate a departmental inquiry against the officer responsible for the violation. If the inquiry results in an adverse finding, departmental action must follow, along with an entry in the officer’s service book.
The Court declared that the power of re-arrest cannot remain with the same police officer who violated the accused’s fundamental rights.
