Sub : Grant of exemption from EDLI Scheme, 1976 under section 17(2A) of the EPS and MPAct, 1952 reg.

Sir,

Kind attention is invited to the instructions issued at regular intervals to conduct review in respect of establishments in the Regions under your jurisdiction which were pending for notification for grant of exemption/extension of exemption under Section 17(2A) of the EPF & MP Act 1952 and send their reports to Head Office. However, it is regretted that due attention to the matter has not been given as it has been observed that a number of cases for exemption from the EDLI scheme are being recommended from retrospective date ranging back to many years. In some cases, the proposal for grant of exemption for more than 20 years old are also being received despite repeated instructions for timely completion of all such pending cases.

2. All the Central P.F. Commissioners are requested to conduct review in respect of each such establishment in the Regions under their jurisdiction and submit the proposal which are due for exemption/further extension and also fresh proposals for grant of exemption if any. All pending proposals for extension or grant of exemption in relaxed cases received upto 31.12.2016 must be forwarded to Head Office by 28.02.2017 along with reasons for delay in forwarding the same to Head Office for each case. Proposal received after 28.02.2017 shall not be entertained and officers concerned will be held personally responsible for such lapses.

3. Further, the Qvisions and benefits under EDLI scheme, 1976 are under examination. Therefore, it has been deeided that relaxation should not be given to any establishment under Para 28(7) of the EDLI Scheme 1976, henceforth, till further orders to avoid any possible complication in future. Proposals received for exemption should be examined for exemption directly and forwarded to Head Office for approval in due course.
