Summary: The Pension Fund Regulatory and Development Authority (PFRDA) has notified the Pension Fund Regulatory and Development Authority (Procedure for Inquiry by Adjudicating Officer) (Amendment) Regulations, 2026, exercising powers under section 52(1), clause (q) of section 52(2), and section 30 of the Pension Fund Regulatory and Development Authority Act, 2013. The amendments come into force from the date of publication in the Official Gazette. The Regulations amend the Pension Fund Regulatory and Development Authority (Procedure for Inquiry by Adjudicating Officer) Regulations, 2015. In regulation 2(f), the word “or” appearing immediately after “adjudicating officer” is replaced by “and”. Regulations 3, 4(1) and 10(2) are amended so that references to “section 28” are replaced with “sub-section (7) of section 16 or section 28”. Regulation 7 is amended by adding the words “before the adjudicating officer and the member” immediately after “to present its case”. Existing regulation 11(3) is substituted to provide that the member may pass an order imposing penalty, if any, as deemed fit, preferably within sixty days from conclusion of the final hearing, having regard to section 30(2) of the Act. The principal Regulations were originally published in the Gazette of India on 6 January 2015 through Notification No. PFRDA/12/RGL/139/1.

PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY (PROCEDURE FOR INQUIRY BY ADJUDICATING OFFICER) (AMENDMENT) REGULATIONS, 2026
No. PFRDA/16/16/03/0002/2017-EnA.— In exercise of the powers conferred by sub-section (1) of Section 52 read with clause (q) of sub-section (2) thereof and section 30 of the Pension Fund Regulatory and Development Authority Act, 2013 (23 of 2013), the Pension Fund Regulatory and Development Authority hereby makes the following regulations, namely:-
1. These regulations may be called the Pension Fund Regulatory and Development Authority (Procedure for Inquiry by Adjudicating Officer) (Amendment) Regulations, 2026.
2. These shall come into force on the date of their publication in the official gazette.
3. In the Pension Fund Regulatory and Development Authority (Procedure for Inquiry by Adjudicating Officer) Regulations, 2015, as amended from time to time (hereinafter referred to as ‘the principal regulations’), the following amendments are made.
I. In clause (f) of regulation 2 of the principal regulations, the words “or” appearing immediately after the word adjudicating officer, shall be replaced with the words “and”.
II. In regulation 3 of the principal regulations, for the words and figures “section 28”, the words, brackets and figures “sub-section (7) of section 16 or section 28” shall be substituted.
III. In sub-regulation 1 of regulation 4 of the principal regulations, for the words and figures “section 28”, the words, brackets and figures “sub-section (7) of section 16 or section 28” shall be substituted.
IV. In regulation 7, immediately after the words “to present its case” the words “before the adjudicating officer and the member” shall be added.
V. In sub-regulation 2 of regulation 10 of the principal regulations, for the words and figures “section 28”, the words, brackets and figures “sub-section (7) of section 16 or section 28” shall be substituted.
VI. Existing sub-regulation (3) of regulation 11, shall be substituted as follows:
“(3) The member may pass an order, imposing penalty, if any, as shall be deemed fit, preferably within a period of sixty days of the conclusion of the final hearing having regard to the provisions of sub-section (2) of section 30 of the Act.”
