All cases involving breach of law doesn’t lead to public disorder

Supreme Court observed that there is difference between “law and order” and “public order” and held that breach of law in all cases does not lead to public disorder.

Facts- Under assail in this appeal is a judgment and order of a Division Bench of the High Court for the State of Telangana. Vide the impugned judgment, a writ petition instituted by the appellant seeking a writ of habeas corpus was dismissed and the order of detention of the appellant’s husband (“Detenu”, impugned therein, upheld.

The Commissioner of Police, Hyderabad City passed the Detention Order against the Detenu under the provisions of section 3(2) of the Telangana Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug-Offenders, Goondas, Immoral Traffic Offenders, Land Grabbers, Spurious Seed Offenders, Insecticide Offenders, Fertiliser Offenders, Food Adulteration Offenders, Fake Document Offenders, Scheduled Commodities Offenders, Forest Offenders, Gaming Offenders, Sexual Offenders, Explosive Substances Offenders, Arms Offenders, Cyber Crime Offenders and White Collar or Financial Offenders Act 1986.

Notably, the Detenu earlier suffered an order of detention dated 4^th March 2021 under the category of “White Collar Offender”; however, pursuant to an order of the High Court, the Detenu was released from detention on 17^th August 2021.
