Pimpri Chinchwad Municipal Corporation Vs Sarang Yadwadkar and Ors. (Bombay High Court)

1. The situation in Maharashtra, because of the pandemic, continues to be grim. Normal functioning of the Courts is yet to be restored. The litigant public may not suffer for no fault on their part. In such view of the matter, we consider it just and appropriate to extend the interim order passed on this suo motu petition, which is due to expire today, till October 31, 2020 on the same terms as directed earlier.

2. Insofar as the applicant (Pimpri Chinchwad Municipal Corporation) is concerned, it seeks an order from us to allow it to comply with the orders dated 26th September, 2019 and 16th June, 2020 passed by the National Green Tribunal in Original Application No.49 of 2020 (WZ). The persons, who would be affected by reason of grant of relief claimed in this application, are not before us. In such view of the matter, relief as prayed for is declined at this stage. It shall be open to the said Municipal Corporation to take steps in accordance with law, as it may be advised.

3. This order will be digitally signed by the Private Secretary of this court. All concerned will act on production by fax or e-mail of a digitally signed copy of this order.
