Sub: Request to Waive off additional fee for filling ADT-1 where From GNL-2 has already been filed by the Companies.
This is with regard to the filing of INC-22 A wherein after Inserting CIN Number all other details are captured from the MCA System, if the respective forms are filed by the Stakeholders and the due date to file Form INC-22A is 25th April, 2019.
In the said form, one of the fields is about the Information of Auditors of the Company which is captured from the Foam ADT-1 which is required to be filed for appointment of auditors.
As you are already aware that for the period 1st April, 2014 to 19th October, 2014, Form GNL-2 was required to be filed for appointment of auditors instead of ADT-1 as ADT-1 was not available at that point of time and those stakeholders who had appointed the Auditors during that period had to the submit Form ADT-1 manually filled and along with GNL 2.
It has been brought to our notice that those stakeholders whose Form GNL-2 had been filed along with Form ADT-1 and other documents, the details are not being captured in the Form INC-22A and these stakeholders are unable to upload the form.
Now, E-Form ACTIVE INC- 22 A mandates the filing of form ADT 1 which is required to be filed by all the Companies with an additional late fee, before filing the ACTIVE form.
In this regard, we request you kindly waive off the Additional fee for filling Form ADT- 1 where Form GNL – 2 has already been filed as the Additional fee will Increase Cost of compliance for the stakeholders for a compliance that has already been undertaken as per the rules in place at that time.
We request you to kindly consider the concern at the earliest as the last date for filling the form is 25th April, 2019
