The Ministry of Corporate Affairs (MCA) has clarified the distinction between its administrative responsibilities and the independent functioning of the National Company Law Tribunal (NCLT) in personnel matters. MCA stated that its role is limited to performing administrative functions in the appointment process of 63 Judicial and Technical Members of the NCLT. In contrast, the NCLT independently handles the appointment and management of its officers and staff, including Deputy Registrars, Court Officers, Stenographers, Office Assistants and Multi-Tasking Staff. This responsibility was delegated to the NCLT by the Government through a notification dated 14 October 2019 to facilitate its effective and independent functioning. The clarification follows certain news reports concerning personnel matters relating to the NCLT that were raised by the Hon’ble Supreme Court. The statement distinguishes the Ministry’s administrative role in the appointment of Tribunal Members from the NCLT’s independent authority over its own establishment and staff.
