The Office of the Principal Commissioner of Income Tax (Judicial), Delhi, has invited applications for empanelment as Senior and Junior Standing Counsels. These counsels will represent the Income Tax Department in the Delhi High Court, NCLT, NCLAT, and other judicial forums. The empanelment is for three years, governed by CBDT Instruction No. 7 of 2016 or subsequent guidelines.

Eligibility Criteria: Senior Standing Counsels must have five years of experience handling direct tax matters in High Courts or ITAT or meet alternate specified qualifications. Junior Standing Counsels require three years of experience in similar matters or equivalent credentials. Retired officers meeting certain conditions are also eligible.

Application Process: Applicants must submit their forms (Form A1/A2) by March 28, 2025, via email (max 12MB) and optionally by post to the Principal Commissioner of Income Tax (Judicial), Delhi. The application must include all supporting documents. Incomplete or improperly formatted submissions will be rejected.

Selection Procedure: Applications will be screened by a committee, followed by interviews for shortlisted candidates. Selected candidates will receive engagement offers for representation duties. Canvassing will result in disqualification.

Notice for Engagement of Senior and Junior Standing Counsels by Income Tax Department, Delhi.

Applications arc invited for the empanelment as Senior and Junior Standing Counsels to represent the Income Tax Department in the High Court of Delhi, NCLT, NCLAT and other judicial fora in direct tax related matters and related litigation.

2. The empanelment will be normally for a time period of 3 years. The procedure of engagement, eligibility conditions, the duties of Standing Counsels, fees payable etc. are subject to Central Board of Direct Taxes (CBDT) Instruction No. 7 of 2016 dated 07.09.2016 (copy enclosed) or any other Instruction issued henceforth on this subject.

Eligibility criteria:

3(a). The cut-off date for meeting the eligibility conditions for the purpose of this empanelment will be 1St January, 2025.

3(b). The eligibility criteria for the applicants seeking engagement as Senior Standing Counsel for the Income ‘Fax Department as prescribed in the Instruction No. 7 of 2016 of CI3DT, arc as under –

“In order to be eligible for engagement as Senior Standing Counsel, a person should:

a) be eligible to appear before the High Court as an advocate and

b) have a minimum experience of five years of handling direct tax matters before high Courts/ITAT as an advocate;

OR

have been a Junior Standing Counsel of the Department for three years;

OR

have been an officer of the Income-tax Department who is eligible to appear &lore the High Court as an advocate and has retired/resigned from the post of Addl. Commissioner/Director of Income-tax or an equivalent post after occupying such post for at least three years or any higher post or who has been a member of 1TAT, provided that he has not been removed/dismissed or compulsorily retired from service on account of disciplinary action and no disciplinary proceeding under service rules or pension rules is pending against him.”

3(c). The eligibility criteria for the applicants seeking engagement as Junior Standing Counsel for the Income Tax Department as prescribed in the Instruction No. 7 of 2016 of CHM’, arc as under —

In order to he eligible fbr engagement as Junior Standing Counsel a per von should:

a) he eligible to appear before the High Court as an advocate and

b ) have a minimum experience of three years of handling preferably direct lax matters 1)c’ re High Courts or HAT;

OR

have been an officer of the Income-tax Department who retired resigned from lire.’ past Additional/Joint CIT or below and is eligible to appear belbre the High Court as an advocate. provided that he has not been removed/dismissed Or cox 2pulsorily retired from service oh account of disciplinary action and 170 disciplinary proceeding under service rules or pension rules is pending against him.

Submission of Application:

4(a) The interested and eligible applicants may submit their application as per the prescribed forms Form Al or Form A2 (as applicable) attached with this document latest by 09 PM on 28th March 2025. All supporting details and documentary evidence, as required. must necessarily be attached with the application form. Applications not in prescribed proforma or incomplete/deficient in any respect are liable to be rejected.

4(b) The applicants seeking engagement as Senior Standing Counsel may convey their willingness for also being considered for empanelment as Junior Standing Counsels.

4(c) The scanned copy of application form. duly signed and completed in all aspects. along w ith the required attachments for supporting documents, is mandatorily to be submitted through ,–mail at 2ov.in. The size of the e-mail with attachments should not exceed 12MB. Applications submitted on any other e-mail id will not be considered.

4(d) A physical copy of the application may also be submitted through Registered Post / Speed Post / Courier or By hand in a sealed cover, addressed to the Pr. Commissioner of Income Tax (Judicial). Delhi, at Room No. 162A, C.R. Building. P. Estate, New Delhi-110002. The sea ed envelope must mention the subject as “APPLICATION FOR EMPANELMENT OF STANDING COUNSEL”. This will be considered only. if application has also been made through e-mail. the stipulated time i.e. 4.00 PM on 28th March 2025. Applications received in any mode t4ffrr the specified date and time will not be considered.

Procedure for selection:

5. The applications complete in all aspects and fulfilling the prescribed eligibility condition.; v ill be considered by the “Screening Committee for Empanelment of Counsels”. The shortlisted candidates shall be invited for interview by the Screening Committee. The candidates appearing for interview will be required to bring originals of the documents submitted with the application fo, The selected candidates shall be given the offer foi engagement as Standing Counsel for the Income Tax Department before the High Court of Delhi. NCI.T. NCLAT and other judicial fore in Delhi.

6. Canvassing in any form would lead to disqualification.
