In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes following amendments to Notification No.93(RE-2007)/2004-2009 dated 1st April, 2008 as amended from time to by substituting Para 2.1.7 added vide Notification No.48 (RE-2008)/2004-09 dated 13th October, 2008, read with Notification No.53 (RE-2008)/2004-09 dated 4th November, 2008.
The issue relating to the Bank guarantees/LUTs executed between the period from 30.06.2008 to 17.11.2008 by pharmaceutical units in lieu of drug manufacturing authorizations was raised in Port Officers’ Meeting held on 25.11.2008 wherein it was clarified that the Bank Guarantees/LUTs submitted to RAs in lieu of submission of DML for obtaining EPCG authorizations may be returned to the pharmaceutical units, upon obtaining an undertaking from such units that they are required to submit DML within a period of three years from the date of issue of EPCG authorisation.

EO shall be fulfilled within 24 months except in case of supplies to projects / turnkey projects in India /abroad under Deemed Export category where EO must be fulfilled during contracted duration.

In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy – 2004-09, the Central Government hereby amends Schedule – I (Imports) of the ITC(HS).
For exports of special products / sectors, the duty credit scrip under this scheme shall be 2.5% of FOB value of exports; and such products / sectors, along with their linked markets, and admissible date of exports, shall be notified in Table 12 of Appendix 37D of HBPv1.
In case of supply by DTA unit to a unit in SEZ, either a separate Certificate from the bank of the Receiving unit or specific endorsement in the BRC evidencing payment in Rupee made from the Foreign Currency Account of SEZ unit.
