In re Acer India Private Limited (GST AAR Tamil Nadu)
In the case In re Acer India Private Limited (GST AAR Tamil Nadu, 2025), the Authority for Advance Ruling examined the classification of “Interactive Flat Panel Displays” (IFPDs) manufactured and supplied by Acer India Pvt. Ltd. The applicant sought clarity on whether IFPDs should be classified under heading 8471 as “Automatic Data Processing (ADP) Machines” or under heading 8528 as “Other Monitors.” The classification was critical because it determined the applicable GST rate. Product Features and Applicant’s Claim
Acer’s IFPDs are large interactive screens equipped with touch functionality, built-in processors, memory, Android operating systems, and compatibility with slot-in PCs. They allow writing, drawing, and collaboration directly on the screen and are widely used in classrooms, conference rooms, and collaborative environments. Acer argued that because the product incorporates computing functions, it should be considered an ADP machine under heading 8471.
The company contended that IFPDs perform functions such as storing and executing programs, enabling arithmetic computations, and operating without human intervention—criteria laid down in Chapter Note 6 to Chapter 84 of the GST Tariff for ADP machines. Hence, the product should qualify under heading 8471.
AAR’s Analysis
