Many a times, there might be a possibility that the applicant or the registered user of a registered trademark intends to change the name of itself. It is especially common in cases where the applicant/registered user is a Company/LLP/partnership firm and the name changes due to structural changes or any other type of changes in the organization. In such cases, we are required to follow the procedure herein mentioned below to get the changed name updated on the Trademark Portal as well:

Step 1: Visit Trademark India website mentioned below and login in with the credentials. https://ipindiaonline.gov.in/trademarkefiling/user/frmLoginNew.aspx

Step 2: Go to New Form Filing > File TM-P > Change Name of Registered Prop/User and mention the application number

Step 3: The Form TM-P will open and we need to fill the contents of it.

Step 4: After filing in the basic details of the form, it is very necessary to attach the power of attorney and the requisite documents evidencing change of name.

Step 5: After attaching the documents, click on save and affix the digital signature to submit the form.

Step 6: Post form submission, the fees of Rs. 1,800/- needs to be paid and the said application shall come under “Uploaded Documents” tab on the “Check Trademark Status”.

Step 7: On approval by the trademark department of the application, the name of the registered proprietor shall change on the portal.

FREQUENTLY ASKED QUESTIONS?

Q1. Can the user/applicant of the unregistered trademark can also apply for change of name?

Reply: No. Also, the system will not accept the application number of the unregistered trademark. 

Q2. Can an applicant himself apply for TM-P for change of name?

Reply: Yes, by following the procedure as aforementioned, the applicant can himself file the application for change of name provided he has the login credentials and if he does not has, he can anytime create it.
