The Ministry of Commerce and Industry has issued a significant directive, the Copper Products (Quality Control) Order, 2024. This order, aimed at regulating the quality standards of copper products, carries implications for various stakeholders.

The order, enacted under the authority vested by the Bureau of Indian Standards Act, 2016, supersedes its predecessor, the Copper Products (Quality Control) Order, 2023. It mandates the compulsory use of Standard Mark for specified goods, ensuring adherence to corresponding Indian Standards. Notably, micro and small enterprises are also obliged to comply with these standards, albeit with a grace period.

Under the order, the Bureau of Indian Standards assumes the role of the certifying and enforcing authority. Any contravention of the provisions outlined in the order is subject to penalties as per the Bureau of Indian Standards Act, 2016. The order, through its provisions and penalties, seeks to uphold quality standards in the production and distribution of copper products, thereby safeguarding consumer interests and promoting industry integrity.

ORDER

New Delhi, the 25th April, 2024

S.O. 1801(E).—In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016), and in supersession of the Copper Products (Quality Control) Order, 2023, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order, namely:-

1. Short title and commencement. – (1) This Order may be called the Copper Products (Quality Control) Order, 2024.

(2) Save as otherwise provided in this Order, it shall come into force on the date of its publication in the Official Gazette.

2. Compulsory use of Standard Mark.-Goods or articles specified in column (2) of the Table shall confirm to the corresponding Indian Standard mentioned in column (3) of the table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018:

Provided that the micro enterprise and small enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively:

Provided that nothing in this order shall apply to goods or articles manufactured domestically for export.

3. Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for the Goods or articles specified in Column (2) of the Table.

4. Penalty for Contravention.-Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.
