The National Consumer Disputes Redressal Commission (NCDRC) has ordered to refund of the full amount paid by five homebuyers in a residential project in Gurugram and also instructed two Delhi-based builders to pay 9% interest for delay in giving possession of the residential flats.

The homebuyers had booked the residential flats in the year 2011 & 2012 in the “RISE” project in Sector-37C in Gurugram, promoted by Ramprastha Promoters and Developers and Blue Bell Protech.

The promoters had assured to give possession of the flats by September 2015 as per Agreement made between the builder and the homebuyers.

While disposing of the 5 complaints filed by the homebuyer in 2016, presiding member of NCDRC Justice Deepa Sharma ordered full repayment with interest to the homebuyers and also imposed Rs 25,000 as a litigation cost in each case.

Justice Deepa Sharma has also directed to the promoters  to make the full payment in four weeks but there was no response from developers.

Justice Sharma also turned down the arguments given by the developers that the project got delayed due to the order of the HC of Punjab and Haryana for use of water for construction.
