Subject: Availability of name-Instructions regarding.

Sir,

Instruction No.8 of the Guiding instructions circulated vide this Department’s letter No. 10(1)-RS/65 dated 27.11.1965 provides that a name in the category mentioned below will not generally be made available:-

“If it attracts the provisions of the Emblems and Names (Prevention of Improper Use) Act, 1950 as amended from time to time i.e., use of improper names, prohibited under this Act.”

2. It is observed from a communication received from the Department of Consumer Affairs that the above said instructions are not being followed scrupulously.

3. The ROCs are advised to take into account the provisions of the above-said Emblems & Names Act while making names available to companies under the Companies Act, 1956.

4. All the ROCs are requested to adhere to the above instructions for strict compliance.
