Summary: The Institute of Company Secretaries of India (ICSI), through its representation dated 28 October 2026 to the Secretary, Ministry of Corporate Affairs, has requested an extension until 31 December 2026 for filing other statutory e-forms without additional fees. The request seeks coverage for forms whose due dates fall between 1 October and 31 October 2026. ICSI acknowledged the Ministry’s earlier relief for annual filing forms and Form CRA-4 but stated that persistent technical and operational problems on the MCA-21 V3 portal continue to affect other filings under the Companies Act, 2013 and the Limited Liability Partnership Act, 2008. Reported difficulties include portal downtime, slow responses, session timeouts, login and user management problems, difficulties associating Digital Signature Certificates, form validation errors, payment failures, and problems accessing and tracking filed forms. According to ICSI, these issues are delaying compliance by companies, LLPs and professionals despite their efforts to meet statutory deadlines. The representation specifically mentions Forms ADT-1, MGT-14, DIR-12, MR-1, MR-2, CRA-2, MSME Form I, PAS-6, LLP Form 8 and forms relating to OPCs. ICSI submitted that the requested relief would allow accurate and effective filing and further Ease of Doing Business and Ease of Compliance. The document is a request for the Ministry’s consideration; it does not itself grant an extension or waive additional fees.

Respected Madam,

Subject: Request for Extension of Due Dates for Filing Other Statutory E-Forms under the Companies Act, 2013 till 31.12.2026 without Levy of Additional Fees

Greetings from the Institute of Company Secretaries of India!

At the outset, the ICSI sincerely expresses its gratitude and appreciation to the Ministry of Corporate Affairs for favourably considering the concerns raised by stakeholders and extending the due dates for filing annual filing forms along with Form CRA-4. This timely intervention has provided much-needed relief to companies and professionals and reflects the Ministry’s continued commitment towards facilitating statutory compliance and promoting Ease of Doing Business.

While the extension of annual filing forms has significantly eased compliance-related pressures, we continued to receive numerous representations from our members and other stakeholders regarding persistent technical glitches and operational challenges on the MCA-21 V3 portal. It is pertinent to highlight that these issues are not confined to annual filing forms alone but are also adversely affecting the filing of various other statutory e-forms under the Companies Act, 2013, and the Limited Liability Partnership Act, 2008.

Stakeholders have reported recurring difficulties, including portal downtime, slow system response, session timeouts, login and user management issues, difficulties in associating Digital Signature Certificates (DSCs), form validation errors, payment processing failures, and challenges in accessing and tracking filed forms.

These technical impediments are resulting in delays and creating considerable difficulties for companies, LLPs and professionals in meeting statutory deadlines, despite their best efforts to ensure timely compliance.

ICSI Submission

In view of the foregoing, and considering that the technical constraints on the MCA-21 V3 portal continue to affect a wide range of statutory filings beyond annual filing requirements, the Institute respectfully requests the Ministry to kindly consider extending the due dates of other statutory e-forms up to 31 December 2026, without levy of additional fees.

The requested extension may kindly cover e-forms due dates of which falling during the period from 1 October 2026 to 31 October 2026 such as Forms ADT-1, MGT-14, DIR-12, MR-1, MR-2, CRA-2, MSME Form I, Form PAS-6, LLP Forms 8 and forms related to OPCs.

Such a measure would enable companies, LLPs and professionals to complete their statutory filings accurately and effectively, rather than being compelled to undertake compliance under severe time constraints caused by persistent system-related impediments. It would also support the Ministry’s broader objective of promoting Ease of Doing Business and Ease of Compliance.

The Institute shall be grateful for the Ministry’s favourable consideration of this request in the larger interest of companies, LLPs, professionals and other stakeholders. We shall be pleased to furnish any additional information or clarification that may be required in this regard.

Thanking you,

Yours faithfully
