MCA Extends Tenure of Eight NCLAT Members for Five Years

Summary: The Ministry of Corporate Affairs (MCA), through Notification S.O. 5205(E) dated 21 September 2026, has extended the tenure of eight members of the National Company Law Appellate Tribunal (NCLAT). The notification has been issued in exercise of powers conferred by section 410 of the Companies Act, 2013, read with section 24(2)(d) of the Tribunals Reforms Act, 2026. The tenure has been extended on the same terms and conditions for a period of five years from the date of appointment or until the member attains the age of sixty-seven years, whichever occurs earlier. The eight members covered by the notification comprise four Judicial Members—Justice Shri Yogesh Khanna, Justice Shri Sharad Kumar Sharma, Justice Sh. N. Sesha Sayee and Justice Sh. Mohammad Faiz Alam Khan—and four Technical Members—Sh. Ajai Das Mehrotra, Sh. Arun Baroka, Sh. Jatindranath Swain and Sh. Indevar Pandey. The notification accordingly continues their respective tenures in NCLAT subject to the prescribed five-year period and age ceiling. Earlier MCA notifications relating to NCLAT appointments also identify Ajai Das Mehrotra and Arun Baroka as Technical Members.

S.O. 5205(E).—In exercise of the powers conferred by section 410 of the Companies Act, 2013 (18 of 2013) read with section 24(2)(d) of the Tribunals Reforms Act, 2026, the Central Government hereby extends the tenure of the following Technical Members in the National Company Law Appellate Tribunal, with the same terms and conditions for a period of 5 years from the date of appointment or till attaining the age of sixty-seven years, whichever is earlier, namely:
